1. Agreement to Terms
These Terms of Service ("Terms") govern your use of the Cove VPN application and any related services (collectively, the "Service") operated by Sebastian Teets LLC ("Cove," "we," "us," or "our").
By downloading, installing, or using Cove, you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old to use Cove. By using the Service, you represent that you meet this age requirement.
2. Description of the Service
Cove is an iPhone application that provides a personal VPN (Virtual Private Network) service. When connected, Cove routes your internet traffic through our servers in the United States to mask your IP address and encrypt your internet connection.
Cove is designed for personal, non-commercial use to enhance your privacy on dating apps and public WiFi networks.
The Service is currently available on iPhone only and is provided in the United States.
3. Account Registration
To use Cove, you must create an account using either an email address and password or Sign in with Apple. You are responsible for:
- Providing accurate and current information when creating your account.
- Maintaining the confidentiality of your login credentials.
- All activity that occurs under your account.
- Notifying us immediately at support@coveprivacy.com if you believe your account has been compromised.
You may not share your account with others or allow others to access your account. Each subscription covers a single user.
4. Subscriptions and Billing
Free Trial: New users receive a 7-day free trial. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically begin and you will be charged.
Subscription Plans:
- Monthly: $9.99 per month, billed monthly through Apple.
- Annual: $79.99 per year, billed annually through Apple.
Billing through Apple: All payments are processed by Apple through the App Store In-App Purchase system. Cove does not directly handle your payment method. By subscribing, you also agree to Apple's terms and conditions for In-App Purchases.
Auto-renewal: Subscriptions automatically renew at the end of each billing period at the then-current price unless cancelled at least 24 hours before the renewal date. Renewal charges are processed within 24 hours before the current period ends.
Price changes: We reserve the right to change subscription prices. We will provide at least 30 days' notice of any price increase, and Apple will notify you before any renewal at the new price.
How to cancel: Cancel your subscription at any time through your iPhone: Settings → [Your Name] → Subscriptions → Cove → Cancel Subscription. Cancellation takes effect at the end of the current billing period — you retain access until then. We are unable to process cancellations or refunds directly; these are handled through Apple.
Refunds: All refund requests are handled by Apple according to their refund policy. We cannot issue refunds directly. To request a refund, visit reportaproblem.apple.com.
5. Acceptable Use
You agree to use Cove only for lawful purposes. You may not use Cove to:
- Engage in any illegal activity, including but not limited to copyright infringement, fraud, hacking, or harassment.
- Send spam, malware, or other harmful content.
- Conduct port scanning, network probing, or any form of attack against any network or system.
- Generate or distribute child sexual abuse material or any content that exploits minors.
- Circumvent geo-restrictions in violation of a third-party service's terms of service where doing so constitutes a legal violation.
- Conduct any activity that places an unreasonable or disproportionate load on our infrastructure.
- Resell, sublicense, or share access to your Cove account or subscription.
We reserve the right to suspend or terminate accounts found in violation of these terms immediately and without notice.
6. No-Log Policy
Cove does not log your browsing activity, visited websites, DNS queries, originating IP addresses, or any content of your VPN traffic. Our data practices are described fully in our Privacy Policy.
We retain only session metadata (connection timestamps and duration) for 90 days for abuse prevention purposes.
7. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted service. The Service may be temporarily unavailable due to maintenance, technical issues, or factors outside our control.
We reserve the right to modify, suspend, or discontinue the Service or any part of it at any time with reasonable notice. In the event of discontinuation, we will notify you and provide a pro-rated refund for any unused prepaid subscription period where possible.
8. Intellectual Property
Cove and its original content, features, and functionality are owned by Sebastian Teets LLC and are protected by copyright, trademark, and other intellectual property laws.
You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written permission.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR COMPLETELY SECURE.
Using a VPN enhances your privacy but does not make you completely anonymous or immune to all security threats. Cove is one tool — not a complete security solution.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SEBASTIAN TEETS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR PERSONAL HARM — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify and hold harmless Sebastian Teets LLC, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your violation of these Terms or your use of the Service in a manner not authorized by these Terms.
12. Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may seek relief in small claims court for disputes within that court's jurisdiction.
Class action waiver: You agree to resolve disputes only on an individual basis and not as part of any class, consolidated, or representative action.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes through the app or by email at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
If you do not agree to the revised Terms, you must stop using the Service and cancel your subscription before the changes take effect.
14. Termination
You may stop using the Service and cancel your subscription at any time.
We may suspend or terminate your access to the Service immediately and without prior notice if we determine, in our sole discretion, that you have violated these Terms.
Upon termination, your right to use the Service immediately ceases. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will survive.
15. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Cove regarding the Service and supersede all prior agreements and understandings.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force.
